Terms of Service of Creative Tech Park

General Terms

1. By purchasing any service from Creative Tech Park, you agree to these terms of service.
2. All payments must be made to the “Creative Tech Park” account via account pay cheque, online card payment, bank deposit, bank fund transfer, bkash or nagad merchant payment.
3. Refunds:
   • Full refunds or exchanges are not provided for any products or services.
   • Partial refunds may be considered within 45 days of purchase, based on management’s discretion. Any refunded amount will be credited to the Creative Tech Park user’s/ customer’s account as a credit balance so that they can purchase other service from creative tech park.
4. Creative Tech Park is not responsible for illegal or copyrighted content uploaded/ provided by clients.
5. All customers must provide a footer credit link to their website design, web application development, software development, billing receipt, or any other visible service rendered by Creative Tech Park. If the customer refuses to provide a footer credit link, Creative Tech Park may take legal action against the client/ customer. A 30% additional service charge maybe applicable for the deletion of footer credit based on management’s discretion.

Domain Services

1. Creative Tech Park acts as a domain registrar agent, charging non-refundable registration fees per the domain registrar’s terms.
2. Domains purchased are subject to ICANN or other relevant naming authority terms and conditions, and clients are responsible for compliance.
3. Domain Transfers:
   • Transferring to another provider requires clearing the full payment of overdue invoices and an official written application on letterhead with a sign and seal or email from the organization head or domain owner verified by the support agent.
4. Renewal:
   • Domains must be renewed at least 1 month before the expiry date.
   • Late renewal incurs additional fees as per renewal rules.
   • Renewal of expired domains after the redemption period cannot be guaranteed.
5. Content Responsibility:
   • Clients are solely responsible for all content hosted on their domain.
   • Clients bear liability for any copyright violations or claims.
6. Refund Policy:
   • No refunds are provided for domain names, SSL certificates, or domain transfers.
   • Services terminated due to violations of terms and policies are non-refundable.
7. Suspension/Termination:
   • Services may be terminated for non-payment or unresolved violations within 7 days of notification.
   • Data may be deleted after termination, but retrieval may be allowed subject to full payment plus applicable fines.

Hosting Services

1. cPanel and domain control panels are provided free of charge.
2. Backup Policy:
   • Backups are taken weekly for internal purposes but are not guaranteed.
   • Clients are responsible for independently backing up their data.
   • Backup restoration services are available for a one-time fee of $50.
3. Suspension/Termination:
   • Creative Tech Park reserves the right to suspend or terminate accounts for:
     • Violations of laws, court orders, or regulations.
     • Hosting illegal or unethical content, phishing, hacking, or piracy activities.
     • Misuse of hosting services, including exceeding resource usage limits.
4. Resource Usage:
   • Users may not exceed 80% of system resources for longer than 60 seconds (90% allowed for premium hosting).
   • Excessive VPS resource usage may result in suspension, reboot, or termination.
   • Prohibited activities include file-sharing, running gaming servers, or unauthorized cron jobs.
5. Renewal:
   • Hosting must be renewed 1 month before expiry to avoid additional fees.
6. Intellectual Property:
   • Creative Tech Park is not liable for hosted content. Copyright complaints should be directed to Creative Tech Park.

SEO Services

1. Creative Tech Park maybe guarantees first-page search engine appearance within a projected timeframe based on the website type and content and commitment.
2. Refund Policy:
   • No refunds are provided for SEO services.
   • If SEO goals are unmet within the projected timeframe, additional optimization services will be provided free of charge.
3. Payment:
   • 100% advance payment is required each month.
   • Clients must provide keywords, content, and guidelines with the work order.

Website, Web Application, Mobile App, Software Development Services

1. Clients must deliver all necessary content / necessary information before starting the project.
2. Payment Terms:
   • 60% advance payment with work order.
   • 20% due payment within 3 days after delivery.
   • The remaining 20% must be paid within 3 days of project completion.
   • All payments will go to the “Creative Tech Park” account via account pay cheque or bank deposit or online transfer or
     merchant mobile banking account paid by the client.
3. Additional Charges:
   • Additional charges depend on clients’ requirements and the salesperson’s negotiation.
   • General Cost for extra work is Ten USD or equivalent BDT per hour. 
4. Timeline:
   • Projects will be deemed complete if clients fail to provide content/ necessary information within 30 days of the contract.
   • Revisions must be submitted within 10 days after delivery.
   • Each quotation includes a project timeline by the salesperson. The client must agree with the timeline mentioned in the quotation.
   • The timeline given in the quotation is counted as working days (excluding Friday, Saturday & Public Holidays)
     from the date of the first payment disbursement.
5. Warranty:
   • A 1-year warranty covers hacking or malware issues for clients using Creative Tech Park hosting servers.
   • Regular backups are recommended. Extended security coverage requires monthly maintenance services.
6. Updates:
   • Free 2-month basic updates are included (design and development work excluded).

Graphics Design Services

1. Payment Terms:
   • 80% advance payment is required.
   • The remaining 20% must be paid within 3 days of project completion.
2. Deliverables:
   • Design files (.ai, .psd, .eps, .pdf, etc.) will be delivered upon full payment.
3. Revisions:
   • Revisions are available as per the selected package.

Digital Advertising Services

1. Advertising costs on digital platforms are tentative.
2. Payment:
   • 100% advance payment is required.
   • Clients must provide all necessary information, content, and guidelines with the work order.
3. Revisions:
   • Revisions are available as per the selected package.

Cancellation Policy

1. Cancellation Requests:
   • Must be submitted before the invoice due date.

Liability Disclaimer

1. Creative Tech Park provides all services and software on an “as-is” basis, with no guarantees of error-free performance.
2. Clients are responsible for ensuring compliance with terms and maintaining service quality.
3. Creative Tech Park is not liable for damages caused by misuse of services, including system attacks or loss of peering.

Note: Creative Tech Park reserves the right to update these terms and policies at any time. By continuing to use the services, clients agree to the updated terms.
